Attorney India A. Butler has successfully submitted a comprehensive research article to the prestigious Journal of the American Academy of Matrimonial Lawyers. Attorney Butler’s article submission was accepted by the Board of Editors and has been published in Volume 37, Number 2 of the Journal. The article submitted by Attorney Butler is entitled “Fault” in Divorce: Its History and Current Role (and a Recommendation for the Future). The submission traces the use and function of “marital fault” from its early origins for both jurisdictional purposes and in its role as a factor for the Court to consider in property division and alimony awards. Attorney Butler’s wide-ranging research spans the laws of various States across the United States and covers the transition from “fault” to “no-fault” statutory schemes, as well as the ongoing impact of fault in those jurisdictions in which fault continues to be a mandatory consideration for Courts in dissolution cases.
